ALIMCO

Artificial Limbs Manufacturing Corporation of India (ALIMCO) is a Schedule ‘C’ Miniratna Category II Central Public Sector Enterprises, registered under Section 8 (Not for Profit motive) of the Companies Act 2013, (corresponding to Section 25 of the Companies Act, 1956) is functioning under the Administrative Control of Ministry of Social Justice & Empowerment, Department of Empowerment of Persons with Disabilities. It is 100% owned Govt. of India Central Public Sector Enterprises with an objective of benefiting the persons with disability to the maximum extent possible by manufacturing Rehabilitation Aids for persons with disabilities and by promoting, encouraging and developing the availability, use, supply and distribution of Artificial Limbs and other Rehabilitation Aids to the disabled persons of the country. Profitability is not the motive of the operations of the Corporation and its main thrust is in providing better quality of Aids & Appliances to larger number of disabled persons at reasonable price. The Corporation started manufacturing artificial aids in 1976. It has five Auxiliary Production Centres (AAPCs) situated at Bhubaneswar (Orissa), Jabalpur (M.P.), Bengaluru (Karnataka), Chanalon (Punjab) and Ujjain. The Corporation has five Marketing Centres at New Delhi, Kolkata, Mumbai, Hyderabad & Guwahati.

The Corporation is the only manufacturing company producing various types of assistive devices under one roof to serve all types of disabilities across the country.

CCPD - Chief Commissioner for Persons with Disabilities

The Office of the Chief Commissioner for Persons with Disabilities is a Government of India agency under the Ministry of Social Justice and Empowerment. This has been set up under the Persons with Disabilities Act, 1995 It is mandated to take steps to safeguard the rights of persons with disabilities. 

 

  1. The Office of the Chief Commissioner for Persons with Disabilities was set up under Section 57 (1) of the erstwhile Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act 1995 and continues to function under Section 74 of the Right of Persons with Disabilities Act, 2016. The Chief Commissioner is mandated to coordinate the work of the State Commissioners for Persons with Disabilities, monitor utilization of funds disbursed by the Central Government and take steps to safeguard the rights and facilities made available to the persons with disabilities. 
  2. The Chief Commissioners may also, on his own motion, or on the application of any aggrieved persons or otherwise looks into complaints relating to deprivation of rights of persons with disabilities or non-implementation of rules, bye-laws, regulations, executive orders, guidelines, or instructions etc. made or issued for the welfare and protection of rights of persons with disabilities and take up the matter with the concerned authorities. The Chief Commissioner for Persons with Disabilities has been assigned certain powers of a Civil Court for effective discharge of the functions.
  3. Commissioner’s office has been an accessible and expeditious site of dispute resolution for PwDs. Most proceeding before the Chief Commissioner relates to matters of employment, promotion or service. Relief, granted to petitioners before the Chief Commissioner, includes directions for reinstatement and advisories to establishments to ensure that PwDs are not discriminated against.

 

 

SCPD - State Commissioners for Persons with Disabilities

Under Section-80 of the Rights of Persons with Disabilities Act, 2016, the State Commissioner for Disability has been entrusted with the task of solving the problems related to the rights of persons with disabilities. (Functions of the State Commissioner) sub-section 80 (b) provides that the State Commissioner shall, suo motu or otherwise, inquire into the deprivation of rights to persons with disabilities and the safeguards available to them in respect of matters for which the State Government is appropriate. Government and will take up the matter with the appropriate authorities for corrective action.

Disability Types, Certification, UDID

Disability

A disability is any condition that makes it more difficult for a person to do certain activities or effectively interact with the world around them (socially or materially). These conditions, or impairments, may be cognitive, developmental, intellectual, mental, physical, sensory, or a combination of multiple factors. Impairments causing disability may be present from birth or can be acquired during a person's lifetime. The United Nations Convention on the Rights of Persons with Disabilities defines disability as:

long-term physical, mental, intellectual or sensory impairments which in interaction with various barriers may hinder [a person's] full and effective participation in society on an equal basis with others.[1]

Disability is a contested concept, with shifting meanings in different communities.[2] It has been referred to as an "embodied difference,"[3] but the term may also refer to physical or mental attributes that some institutions, particularly medicine, view as needing to be fixed (the medical model). It may also refer to limitations imposed on people by the constraints of an ableist society (the social model); or the term may serve to refer to the identity of disabled people. Physiological functional capacity (PFC) is a measure of an individual's performance level that gauges one's ability to perform the physical tasks of daily life and the ease with which these tasks are performed. PFC declines with age and may result to frailty, cognitive disorders, or physical disorders, all of which may lead to labeling individuals as disabled.[4] According to the World Report on Disability, 15% of the world's population or 1 billion people are affected by disability.[5] A disability may be readily visible, or invisible in nature.

Unique Disability ID

"Unique ID for Persons with Disabilities” project is being implemented with a view of creating a National Database for PwDs, and to issue a Unique Disability Identity Card to each person with disabilities. The project will not only encourage transparency, efficiency and ease of delivering the government benefits to the person with disabilities, but also ensure uniformity. The project will also help in stream-lining the tracking of physical and financial progress of beneficiary at all levels of hierarchy of implementation – from village level, block level, District level , State level and National level.

The UDID project initiated by Department of Empowerment of Persons with Disabilities aims at building a holistic end-to-end integrated system for Issuance of Universal ID & Disability Certificates for Person with Disabilities with their identification and disability details. It includes -

  1. Online availability of data of Person with Disabilities across country through a centralized web application
  2. Online filing and submission of registration application form for disability certificate/ Universal ID card; Offline applications may also be accepted and subsequently digitized by agencies
  3. Quick Assessment process for calculating the percentage of disability by the hospitals/ Medical Board
  4. Non-duplication of PwDs data
  5. Online renewal and update of information by Person with Disabilities/ on their behalf
  6. MIS reporting framework
  7. Effective management including interoperability of the benefits / schemes launched by the Government for PwD
  8. To take care of additional disabilities in future. Number of disabilities at the moment is seven and shall be subject to increase as per the new Act/ notification.

Given below is the brief description of the workflow involved in the card generation process along with the key users who shall use the application:

  1. PwDs are required to register with the UDID portal. Once registered, after the login is complete, they will be able to apply online for Disability Certificate and UDID card. They will also be able to track the status of their application. They can put forward their request for renewal of Disability Certificate/UDID Card and also request for another card in case of loss of their UDID Card. They can also download and print the copy of their respective Disability Certificate/UDID Card. One of the unique features shall be the ability to locate their CMO Office/Medical Authority for assessment of disability, District Welfare Officer to receive assistance and to know about the various schemes for Persons with Disabilities. They will also be able to view latest news/announcements pertaining to disabilities.
  2. Disability Certificate Issuing Authorities (CMO Office/Medical Authority) will use this application to record the details of Persons with Disabilities (PwDs) and issue Disability Certificate/UDID Card electronically. Application from the PwD will be received by the CMO Office/Medical Authority. After necessary verification, the PwDs will be referred to designated Specialist/Medical board for disability assessment and once the assessment is over, the assessment details are submitted and Disability Certificate/UDID Card will be issued electronically. Automating Disability Certificate/UDID Card issue process will significantly reduce the time and timely delivery of the Disability Certificate/UDID Card assured.
  3. District Welfare Officer/District Social Welfare Officers shall use the UDID portal for facilitating PwDs in getting Disability Certificate/UDID Card by means of providing application receiving counter, facilitating in Camps. The web portal would also facilitate smooth implementation of schemes meant for PwDs.
  4. District Collectors will use this application to monitor implementation of the UDID project and its effectiveness. They will use of some of the basic reports/summaries generated from UDID portal.

Govt Schemes, Programmes and Policies

The Comprehensive Program for Persons with Disabilities aims to promote services to all types of PWDs 0-59 years of age and are members of the Self-Help Groups of PWDs. The program focuses on areas of disability prevention, rehabilitation and equalization of opportunities. Moreover, it is intended to enhance PWDs capacity to attain a more meaningful, productive and satisfying way of life and ultimately become self reliant, productive and contributing members of society.

 

The Government of India has enacted three legislations for persons with disabilities viz. (i) Persons with Disability (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, which provides for education, employment, creation of barrier-free environment, social security, etc

National Awards

Empowerment of persons with disabilities is an inter-disciplinary process, covering various aspects namely, prevention, early detection, intervention, education, vocational training, rehabilitation and social integration etc. Apart from resources, it requires dedicated efforts of persons and institutions involved in the process of empowerment. In order to recognise their effort and encourage others to strive to achieve excellence in this field, the National Awards for Empowerment of Persons with Disabilities are being awarded every year.

Till 2017, the Award Scheme was governed under the National Awards Rules, 2013 which provided 7 categories of disabilities as per the Persons with Disabilities Act, 1995. However, with the coming into force of the Rights of Persons with Disabilities Act, 2016 w.e.f. 19th April 2017, the number of specified disabilities increased from 7 to 21 under the new Law. Accordingly, all the 21 disabilities have been included under the National Award Guidelines which have been notified in the Extraordinary Gazette of India dated 2nd August, 2018.

Over a period of time, National Institutes (NIs) in the field of disability have been set up under this Department. NIs are in the nature of autonomous bodies established under Society Registration Act focusing on specific types of disabilities. National Institute of Mental Health and Rehabilitation (NIMHR), Sehore

Cabinet approved the proposal of Establishment of National Institute of Mental Health Rehabilitation (NIMHR) at Sehore, Madhya Pradesh in October, 2018 under the aegis of this Department.  Total approved cost (both Recurring and Non Recurring) for initial three years is Rs.179.54 crore out of which Rs.105.68 crore is for construction of building of NIMHR. NIMHR has been registered as a Society under the Madhya Pradesh Societies Registration Act, 1973 on 28.05.2019.  Construction of the building of the Institute is under progress through CPWD. Meanwhile, the Institute has started functioning from a rented accommodation from 30.09.2019.

Composite Regional Centre for Skill Development, Rehabilitation & Empowerment of Persons with Disabilities (CRCs)

Department has approved setting up of 21 Composite Regional Centres (CRCs) as extended arms of National Institutes. Basic objective of CRCs are to provide rehabilitation services to all categories of Persons with Disabilities (PwDs), train rehabilitation professionals, workers and functionaries, undertake programmes of education and skill development for PwDs and create awareness among parents and the community regarding needs and rights of PwDs. District Disability Rehabilitation Centre (DDRC) is an initiative by the Ministry of Social Justice and Empowerment, Govt. of India, to facilitate comprehensive services to Persons with Disabilities in the rural areas.  These units have a group of rehabilitation professions for providing services like identification of Persons with Disabilities, Awareness Generation, Early Detection and Intervention, Provision / Fitment, Follow-up and repairing of Assistive Devices, Therapeutic Services like Physiotherapy, Speech Therapy etc., and facilitation of Disability Certificates, Buss Passes and other concessions/ facilities for Persons with Disabilities.

 

DDRC’s is a joint venture of Central and State Governments wherein Central Government will establish, initiate, implement the centre for three years involving funding for man power contingencies as well as required equipments and coordination.  State Government will provide provision for rent free , well connected building, basic infrastructure, furniture, monitoring and coordination of activities through District Management Team (DMT) Chaired by the District Collector and also identification of implementing agency.

National Trust

Introduction
The National Trust is a statutory body of the Ministry of Social Justice and Empowerment, Government of India, set up under the “National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities” Act (Act 44 of 1999).

Vision of The National Trust
An inclusive society which values human diversity and enables and empowers full participation of Persons with Disability to live independently with dignity, equal rights and opportunities.

The National Trust’s vision statement reflects a very changed India for all Indians and is based on a human rights, i.e. UNCRPD, approach. The vision statement focuses NT as being a leader in the disability sector in India. As laws focusing on Persons with Disability are changing, focused leadership needs to be established. Working through local and regional registered organizations and local level committees, the National Trust must make its vision and focus clear throughout the country.

 

Mission of the National Trust
The National Trust works towards providing opportunities for capacity development of Persons with Disability and their families, fulfilling their rights, facilitating and promoting the creation of an enabling environment and an inclusive society.

The National Trust’s mission, or fundamental purpose, is to create an enabling environment, i.e. providing opportunities for Persons with Disabilities through comprehensive support systems which can also be done by collaborating with other Ministries, etc., which will lead towards development of an inclusive society.

Objectives
The objectives of the National Trust in particular are :-

to enable and empower persons with disability to live as independently and as fully as possible within and as close to their community as possible;
to facilitate the realisation of equal opportunities, protection of rights and full participation of persons with disability;
to extend support to its registered organisations to provide need based services; and
to evolve procedures for appointments of guardians and trustees for persons with disabilities.

NHFDC

The National Handicapped Finance and Development Corporation (NHFDC) has been set up by the Ministry of Social Justice & Empowerment, Government of India on 24th January 1997. The company is registered under Section 25 of the Companies Act, 1956 as a Company not for profit. It is wholly owned by Government of India and has an authorised share capital of Rs. 400 crores (Rupees Four Hundred Crore only). The company is managed by Board of Directors nominated by Government of India.

NHFDC functions as an Apex institution for channelising the funds to persons with disabilities through the State Channelising Agencies (SCAs) nominated by the State Government(s).

Rehabilitation Council of India

The Rehabilitation Council of India(RCI) was set up as a registered society in 1986.On September,1992 the RCI Act was enacted by Parliament and it became a Statutory Body on 22 June 1993.The Act was amended by Paliament in 2000 to make it more broadbased.The mandate given to RCI is to regulate and monitor services given to persons with disability,to standardise syllabi and to maintain a Central Rehabilitation Register of all qualified professionals and personnel working in the field of Rehabilitation and Special Education.The Act also prescribes punitive action against unqualified persons delivering services to persons with disability.

Rights of Disabled people as per RPwD Act 2016

The Rights of Persons with Disabilities Act, 2016 is the disability legislation passed by the Indian Parliament to fulfill its obligation to the United Nations Convention on the Rights of Persons with Disabilities, which India ratified in 2007. The Act replaced the existing Persons With Disabilities Act, 1995
